POPI Act
Hospitality and Outdoor is dedicated to protecting the privacy of its clients, candidates, and website visitors, and is fully compliant with the Protection of Personal Information Act, 4 of 2013 (POPIA or POPI ACT). This policy applies when we act as a data controller for personal data of clients, candidates, and website visitors, meaning when we determine the purpose and means of processing that data.
In this policy, “we,” “us,” and “our” refer to Hospitality and Outdoor. The POPI Act requires us to inform our data subjects of our intention to use their information, and to protect it from any internal or external, deliberate or accidental threats to ensure business continuity. This policy outlines our company’s framework and measures for protecting individuals’ privacy.
We will take reasonable steps to ensure that personal information obtained from candidates or clients is stored safely and securely, including certificates, references, qualifications, background checks, and any other personal information needed for candidate representation. Personal information is collected directly from candidates, and we will only use or release it with their consent, except when required by law. In the latter case, we will always inform the candidate.
We collect personal information for recruitment purposes and use it to represent candidates to our clients for employment opportunities. We are responsible for ensuring that the candidate information is complete, up-to-date, and accurate, and may need to request updates from time to time. We will secure personal information against unauthorized or unlawful access or processing, and ensure that it is only used for lawful purposes with candidate consent.
Candidates have the right to know the details of their personal information held by us, as well as the identity of any authorized employees with access to it.
By sending us their application, candidates agree to the following:
- They have read and understood our POPI policy, and have no objection to us keeping their personal information on our database for future positions.
- They are aware that we will contact them and obtain consent before sending their CV to a client.
- They confirm that they have provided correct and up-to-date information, and will update us on any changes.
- They are aware that we have access to their personal information, including their name, ID or passport number, address, phone number, relationship status, gender, date of birth, photo, portfolios, educational and employment details.
By providing Hospitality and Outdoor with their personal information, candidates are giving us permission to use it for recruitment purposes. Candidates have the following rights:
- The right to know what information we have and how it is being used.
- The right to view this policy on our website at any time.
- The right to update and change their information at any time.
- The right to revoke their consent, in writing to francois@hospitalityandoutdoor.co.za. Note that revoking consent is not retroactive and will not affect the use of their information already made.
Francois Espag is our POPI ACT Officer, and all employees have been trained in this policy and its implementation. Hospitality and Outdoor reserves the right to amend this policy at any time, with an updated copy available on our website. The current version will be applicable unless otherwise stated.
